The following conditions apply to participation in the social media competition of HDI AG, HDI-Platz 1, 30659 Hanover (hereinafter referred to as "HDI" or "organizer") ("conditions of participation"). HDI is the organizer of the competition.
1. Participation
1.1 By participating in the competition, you ("participant or "you") agree to the terms and conditions of participation.
1.2 All natural and legally competent persons with a minimum age of 18 years, permanent residence within Germany and a recipient address for the prize in Germany are eligible to participate. Likewise, only those who can provide proof of their current student status (e.g. in the form of a certificate of enrollment) may participate.
1.3 The prerequisite for participation in the competition is that the participant follows the Instagram channel "HDI Career" (https://www.instagram.com/hdi_career/?hl=de) until XX, "likes" the competition post published by HDI, shares the HDI competition post in his/her own story and comments on the competition post.
1.4 Participation in the competition is only possible in the period between XX and XX (hereinafter "Closing Date") and only via Instagram.
1.5 Participation is only possible with your own Instagram channel. However, the following persons are excluded from participation: Employees of the organizer and of companies affiliated with the organizer as well as their relatives and all persons who were involved in the creation or implementation of this competition. Multiple participation in the competition is excluded.
1.6 There is no entitlement to participate in the competition. HDI is entitled to exclude participants from the competition who manipulate or attempt to manipulate the participation process or the prize draw, or who violate the conditions of participation or common decency or otherwise attempt to influence the competition in an unfair or dishonest manner. In particular, an attempt to participate more than once justifies exclusion from the competition. If the existence of a reason for exclusion is only established subsequently, HDI is entitled to subsequently disallow and reclaim prizes.
1.7 Participation in the competition is free of charge. Neither participation in the competition nor the chance to win is dependent on the purchase of goods or services or the subscription to a newsletter.
2. Implementation of the competition
2.1 The winners will be determined by drawing lots. By participating in the competition, the participant consents to the publication of his/her Instagram profile on the Instagram channel "HDI Career" (https://www.instagram.com/hdi_career/?hl=de) under the corresponding competition post for the purpose of notifying the winner in the event that he/she is drawn as a winner. Persons who have not won will not be informed separately.
2.2 The winners will be named by HDI on the "HDI Career" Instagram channel (https://www.instagram.com/hdi_career/?hl=de) after the closing date. The winners must then contact the "HDI Career" Instagram channel (https://www.instagram.com/hdi_career/?hl=de) by direct message to provide their contact details for the prize to be sent. If a winner does not contact HDI within 21 days of the announcement of the winners on the Instagram channel "HDI Career" (https://www.instagram.com/hdi_career/?hl=de), the claim to the prize will be forfeited and a replacement winner will be determined in accordance with the procedure described above. The participant is responsible for ensuring that the contact details provided are correct. In the event of incorrect allocation of the non-cash prizes due to incorrect data, the entitlement to the prize shall lapse.
2.3 The winners of the competition will receive one of the following prizes: A Stanley Cup, an e-scooter, an iPad and a pair of AirPods. All items are branded by HDI. Each item can be won once by a participant.
2.4 The prizes cannot be paid out in cash or exchanged. The prize claim cannot be assigned to third parties.
2.5 If the fulfillment of a prize claim is not possible or unreasonable, the winner will receive an equivalent replacement.
2.6 HDI reserves the right to change the conditions of participation at any time.
2.7 Unless otherwise stated in the conditions of participation or the competition description, the fulfillment of prize claims for prizes involving movable property shall take place at HDI's place of business. HDI shall not bear any further costs.
3. Liability
3.1 HDI's liability for slightly negligent breaches of duty is excluded with the exception of the breach of essential contractual obligations (so-called cardinal obligations, i.e. obligations whose fulfillment is essential for the proper execution of the competition and on whose compliance the other party may regularly rely). HDI's liability shall be limited to compensation for the foreseeable, contractually typical and direct damage according to the nature of the respective service.
3.2 If the prize has a material defect or defect of title, HDI shall only be obliged to compensate the winner for the resulting damage if HDI has fraudulently concealed this defect.
3.3 Furthermore, the winner shall have no further rights to the prize or claim compensation for damages due to material defects or defects of title.
3.4 The above limitation of liability also applies to the personal liability of employees, representatives and bodies of the organizer.
4. Premature termination of the competition
4.1 HDI reserves the right to cancel or interrupt the competition at any time without prior notice. This applies in particular if, for technical reasons (e.g. viruses in the computer system, manipulation or errors in the hardware and/or software) or for legal reasons, proper execution of the competition cannot be guaranteed.
4.2 Claims for performance and damages by the participant in the event of premature termination of the competition in accordance with section 4.1 are excluded within the framework of the provisions of section 3.1.
5. Competitions via social networks
5.1 If the competition is conducted via social networks such as Instagram, it should be noted that the respective social networks are not associated with the competition. This is an offer in which only HDI is entitled or obligated.
5.2 If the competition is carried out via social networks, a channel on the corresponding social network is required for participation in the competition. This means that consent to the terms and conditions (https://developers.facebook.com/terms) and guidelines of the relevant social network (https://privacycenter.instagram.com/policy/?entry_point=ig_help_center_data_policy_redirect) may also be a prerequisite for participation in the competition.
6. Data protection
6.1 By participating in the competition, the participant expressly agrees that the personal data provided may be collected by HDI for the purpose of conducting and handling the competition for the duration of the competition and its handling.
6.2 Each participant is entitled to request information about which personal data is stored as part of the competition or to change this data. Each participant may revoke their consent to the processing and use of their personal data at any time with effect for the future. The request for information and changes as well as the revocation must be sent to HDI AG, HDI-Platz 1, 30659 Hannover or via e-mail to privacy@talanx.com with the keyword "Instagram competition HDI Career".
6.3 In the event of revocation before the end of the competition, the data will be deleted and the deletion of the data is associated with the termination of participation in the competition. In this case, it is no longer possible to win.
7. Other provisions
7.1 Should individual provisions be or become invalid, this shall not affect the validity of the remaining provisions. An invalid provision shall be replaced by a provision that comes closest to the intention of the parties within the scope of what is legally possible. The same applies to contractual loopholes.
7.2 These terms and conditions are subject exclusively to the law of the Federal Republic of Germany; the place of jurisdiction is Hanover.
7.3 Recourse to the courts is excluded.
